These Terms and Conditions ("Terms") govern your use of this website and, together with our engagement letter, the legal services we provide to you. By accessing this website or instructing us to act on your behalf, you accept these Terms in full.

If you do not agree with any part of these Terms, please do not use this website or engage our services. We recommend that you save or print a copy of these Terms for your records.

2. Who We Are

Kasih Guaman is a legal practice based at Jalan Tuanku Abdul Rahman 129, 50100 Kuala Lumpur, Malaysia. Our practising lawyers are members of the Malaysian Bar and hold current practising certificates issued by the Bar Council of Malaysia.

5. Engaging Our Legal Services

Before we begin work on your matter, we will provide you with a written engagement letter setting out the scope of work, the fee structure, and the terms of our retainer. Our engagement is conditional upon:

• Completion of our client identification and verification process, as required under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA);
• Receipt of any retainer or upfront payment specified in the engagement letter;
• Signed acknowledgement of these Terms and the engagement letter.

Until the engagement letter has been signed and any required payment received, we are under no obligation to provide legal advice or take any steps in relation to your matter.

6. Fees and Payment

Our fees are set out clearly in the engagement letter provided before any work commences. The indicative prices listed on this website — including RM 240 for an initial consultation, RM 720 for separation and divorce representation, and RM 1,500 for child arrangement and maintenance matters — are starting figures. The final fee for your matter will depend on its complexity, the time involved, and the scope of work agreed.

Unless otherwise agreed in writing:

• Invoices are payable within 14 days of the invoice date;
• We reserve the right to suspend work on a matter where invoices remain unpaid;
• Disbursements (such as court filing fees, process server fees, and related costs) are charged separately and will be itemised in our invoices;
• All fees are stated exclusive of any applicable government taxes or levies.

7. Confidentiality and Privilege

All information shared with us in the course of an engagement is subject to legal professional privilege and our duty of confidentiality as your legal advisors. We will not disclose your information to any third party without your consent, except where we are required to do so by law or by an order of court.

8. Intellectual Property

All content on this website — including text, design, layout, logos, and graphics — is the property of Kasih Guaman or its licensors and is protected by applicable copyright and intellectual property laws. Documents and written work product we prepare for you as part of an engagement are provided for your use in that matter. They remain our intellectual property until all outstanding fees have been settled in full.

Our liability in connection with any legal services engagement is limited as set out in the engagement letter. Nothing in these Terms excludes liability for death or personal injury arising from our negligence, or for any other matter that cannot lawfully be excluded or limited.

This website may contain links to external websites operated by third parties, including government agencies and professional bodies. These links are provided for your convenience and do not imply endorsement by Kasih Guaman of the content, products, or services on those sites. We have no control over, and accept no responsibility for, external websites or their content.

11. Termination of Engagement

Either party may terminate a legal services engagement by giving written notice to the other. Where you terminate the engagement, fees for work already completed up to the date of termination remain payable. Where we terminate the engagement, we will give you reasonable notice and will take reasonable steps to avoid prejudicing your position, including advising you to seek alternative representation promptly.

We reserve the right to withdraw from an engagement without notice where continued representation would require us to act in contravention of our professional obligations or applicable law.

12. Complaints and Disputes

We take client feedback seriously and aim to address any concerns promptly and fairly. If you are dissatisfied with any aspect of our service, please contact us in the first instance by writing to [email protected] or by telephoning +60 3-2693 4180. We will acknowledge your complaint within 3 working days and aim to provide a substantive response within 14 working days.

If your concern relates to professional conduct, you also have the right to raise a complaint with the Malaysian Bar Council through its established complaints procedure.

13. Governing Law

These Terms, and any engagement with Kasih Guaman, are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with these Terms or any engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in law, practice, or our services. The revised Terms will be published on this website with an updated date. Where a change is material, we will take reasonable steps to bring it to your attention. Continued use of this website or continued engagement after a change has been published constitutes acceptance of the revised Terms.
